CITY COUNCIL <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 75-201 <br /> <br /> DENYING REQUEST FOR A MODIFICATION OF THE SUBDIVISION <br /> ORDINANCE PROVISIONS OF THE CITY OF PLEASANTON, ESPECIALLY <br /> §2-3.40, ARTICLE 7, CHAPTER 1, TITLE II OF THE ORDINANCE <br /> CODE OF THE CITY OF PLEASANTON, RELATING TO PRIVATE STREETS <br /> <br />WHEREAS, Dr. Howard Long, through his attorney, Mr. Gilbert Maines, <br /> on July 17, 1975, made an application to the Planning <br /> Commission of the City of Pleasanton for modification of <br /> Sections 2-3.40 and 2-4.01 of Article 7, Chapter 1, <br /> Title II of the Ordinance Code of the City of Pleasanton; <br /> and <br /> <br />WHEREAS, said modification specifically requested authorization to <br /> develop subdivision map #3256 with a private street having <br /> a minimum 18 feet of pavement within a 23-foot right-of- <br /> way and a modification of the City's lot standard requir- <br /> <br />ing a minimum frontage on a street of 35 feet; and <br />WHEREAS, on August 4, 1975, at the Justice Court, 30 West Angela, <br /> <br /> Pleasanton, the Planning Commission of the City of Pleasan- <br /> ton held a hearing to consider evidence, testimony and <br /> witnesses in regard to the above application; and <br /> <br />WHEREAS, the Planning Commission received a report from staff con- <br /> sisting of a written report from the City Attorney, to <br /> which was attached Exhibits A thru P, and Exhibits 1 61 <br /> were received from the City at said hearing; and <br /> <br />W'HEREAS, the applicant and his representatives were afforded the <br /> opportunity to question City's witnesses as well as to <br /> <br /> submit witnesses, documents and testimony of his own; and <br />WHEREAS, at the conclusion of the hearing the Planning Commission <br /> <br /> adopted Resolution No. 1360 denying the requested modifi- <br /> cation for a private street and indicating that favorable <br /> consideration would be given to modifying the 35-foot <br /> frontage requirement of §2-4.01; and <br /> <br /> <br />
