which includes provisions of the Subdivision Map Act <br /> relating to approval of subdivision maps; and that con- <br /> sideration of §66474.6 of the Government Code is a valid <br /> exercise of the police powers retained by the City of <br /> Pleasanton; and <br /> <br />I~EREAS, the applicant, Morrison Homes Corporation, was afforded <br /> an opportunity to refute the comments and cogentions of <br /> the City Attorney; and <br /> <br />WHEREAS, the City Council then considered the testimony and evi- <br /> dence submitted to it; <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE AS FOLLOWS: <br /> <br />Section 1. Denies the appeal of Morrison Homes Corporation from an <br /> adverse decision of the Planning Commission denying ten- <br /> tative Tract Map #3606 (Woodthrush); <br /> <br />Section 2. The basis for denial is in accordance with the decision <br /> of the Planning Commission set forth in its resolution <br /> No. 1375 (attached hereto and incorporated herein by <br /> reference) that approval of Tentative Tract Map #3606 <br /> would result in a violation of Cease and Desist Order <br /> No. 75-14 of the Regional Water Quality Control Board, <br /> <br /> San Francisco <br /> <br /> provisions of <br />Section 3. Recommends <br /> <br /> sideration at <br /> <br />Bay Region, and thus, is contrary to the <br />§66474.6 of the Government Code. <br />that the applicant submit a map for con- <br />such time as additional sewage capacity is <br /> <br /> provided at the Sunol Sewage Treatment Plant by the <br /> Regional Water Quality Control Board. <br /> <br />Section 4. The City Clerk shall cause a copy of this resolution <br /> to be transmitted to the applicant and any other interes- <br /> ted parties. <br /> <br />Section 5.
