CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 75-246 <br /> <br />DENYING APPEAL OF MORRISON HOMES CORPORATION FROM AN <br />ADVERSE DECISION OF THE PLANNING COMMISSION REGARDING <br />TENTATIVE TRACT #3606 <br /> <br />WHEREAS, the Planning Commission of the City of Pleasanton con- <br /> sidered at its meeting of October 8, 1975 a request for <br /> <br />approval of Tentative Tract Map #3606 (Woodthrush); and <br />WHEREAS, said Planning Commission considered a staff report dated <br /> <br /> September 10, 1975 to which were attached Exhibits A thru <br /> D; and <br /> <br />WHEREAS, after considering all relevant information supplied by <br /> staff and applicant, the Planning Commission denied <br /> Morrison Homes Corporation request for approval of Tenta- <br /> Tract Map #3606, setting forth its reasons for denial in <br /> Resolution #1375; and <br /> the Planning Commission made its determination that the <br /> Tentative Tract Map should be denied since it would cause <br /> a violation of §66474.6 of the Government Code, i.e. that <br /> the discharge of waste from the proposed subdivision <br /> would result in a violation of Cease and Desist Order <br /> No. 75-14 of the Regional Water Quality Control Board of <br /> San Francisco Bay Region; and <br /> subsequent to the action of the Planning Commission, <br /> Morrison Homes Corporation prosecuted this appeal to the <br /> City Council pursuant to applicable provisions of the <br /> Subdivision Map Act and the City's subdivision ordinances; <br /> and <br /> at a regular Council meeting held on November 24, 1975, <br /> Morrison Homes Corporation, thru their attorney, Mr.Howard <br /> Bell, advised the City Council that it was Mr. Bell's <br /> opinion that a denial of Tract Map #3606 would violate <br /> <br />WHEREAS, <br /> <br />I~HEREAS, <br /> <br />~/~EREAS, <br /> <br /> <br />
