CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 76-64 <br />DECLARING THAT WEEDS, RUBBISH OR REFUSE UPON OR IN <br />FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN THE <br />CITY OF PLEASANTON CONSTITUTE PUBLIC NUISANCES AND <br />THAT THE SAME SHALL BE ABATED, AND SETTING A PUBLIC <br />HEARING IN REGARD TO SAME. <br />WHEREAS, there is attached hereto and incorporated by reference <br />herein as if fully set forth herein a list of properties <br />to which the declaration herein applies; and <br />WHEREAS, said list of properties specifically sets forth street, <br />lot and block numbers according to the official assessment <br />map for each piece of property included therein; and <br />WHEREAS, the properties listed therein have, upon or in front of <br />them, weeds, rubbish or refuse, such as defined by X39561.5 <br />of the Government Code; and <br />WHEREAS, after consideration of evidence both oral and document <br />it appears clear that said weeds, rubbish or refuse are a <br />public nuisance in that they constitute a fire hazard, or <br />that said materials are noxious or dangerous, and as such <br />are detrimental to the health, safety and welfare of the <br />City of Pleasanton, and as such shall be removed; and <br />WHEREAS, it appears that the public nuisances referred to herein <br />are recurrent and seasonal in nature. <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />Section 1. That the weeds, rubbish or refuse upon or in front <br />of the properties described in the list attached hereto <br />and incorporated by reference herein are declared a public <br />nuisance and are to be abated and removed pursuant to the <br />procedure provided for in Section 39560, et seq. of the <br />Government Code. <br />Section 2. That the public nuisances described herein are of <br />a seasonal and recurrent nature. <br />Section 3.
