CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 76-115 <br />A RESOLUTION INITIATING ANNEXATION OF LEGALLY <br />UNINHABITED TERRITORY ON OLD SANTA RITA ROAD <br />TO BE KNOWN AS ANNEXATION N0. 71 <br />WHEREAS, the City Council received a request from Mr. William <br />Rose, regarding the possibility of annexing property <br />owned by Mr. Rose on old Santa Rita Road, north of <br />the intersection of Santa Rita and Tassajara Road; and <br />WHEREAS, Mr. Rose's property is located in an unincorporated <br />area surrounded on three sides by the City of Pleasanton <br />and on the north by Interstate 580; and <br />WHEREAS, said area is legally uninhabited territory; and <br />WHEREAS, Government Code Section 35310 authorizes a city to <br />initiate the annexation of legally uninhabited terri- <br />tory. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br />section 1. Pursuant to Government Code Section 35310, the City <br />Council initiates the annexation of approximately 16.4 <br />acres of legally uninhabited territory bounded on the <br />north by Route 580 and by existing City limits on the <br />west, south and east, said property being more particu- <br />larly described in Exhibit A attached hereto and in- <br />corporated herein by reference, and said annexation is <br />initiated for the following reasons: <br />1. The area in question cannot annex to any other <br />city than the City of Pleasanton. <br />2. The property is located within the sphere of in- <br />f luence of the City of Pleasanton, as approved by <br />the Local Agency Formation Commission. <br />3. The area can be logically served by municipal ser- <br />vices of the City of Pleasanton. <br />4. The inclusion of this unincorporated area, within <br />the boundaries of the City of Pleasanton, will fill <br />
