CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-025 <br /> <br />RESOLUTION OBJECTING TO COUNTY SALE OF TAX <br />DEFAULTED PROPERTY (FOOTHILL ROAD - APN 946 <br />3540 003) AND FINDING THAT THE PROPERTY IS <br />NEEDED FOR PUBLIC USE BY THE CITY OF <br />PLEASANTON <br /> <br />WHEREAS, <br /> <br />the County Tax Collector has advised the City that a 0.29-acre parcel of property <br />located at Foothill Road adjacent to City-owned open space at Laguna Oaks (APN <br />946 3540 003) (the "Property") has become subject to sale for failure to pay taxes <br />in the mount of approximately $4,687.14; and <br /> <br />WHEREAS, <br /> <br />pursuant to California Revenue & Taxation Code §3695.4, the City of Pleasanton <br />objects to the sale of the Property because the entire Property is needed for public <br />parks and recreation purposes (open space) within the City; and <br /> <br />WHEREAS, the City requires a fee interest in the entire 0.29-acre parcel for public parks and <br /> recreation use (open space). <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Objects to the County Tax Collector's sale of 0.29-acre parcel of property located <br />at Foothill Road adjacent to City-owned open space at Laguna Oaks (APN 946 <br />3540 003) because the property is needed for public parks and recreation uses <br />(open space) by the City of Pleasanton. <br /> <br />Section 2: <br /> <br />Directs the City Manager to execute all necessary documents and agreements to <br />effectuate the City's acquisition of the Property from the County, including but not <br />limited to the execution of an application to purchase the Property under Chapter 8 <br />of the California Revenue & Taxation Code. <br /> <br />Section 3: <br /> <br />Appropriates the necessary ~mds from the In-Lieu Park Dedication Fee fund to <br />pay for the acquisition of the Property. <br /> <br />Section 4: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
