WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 76-235 <br /> <br />A RESOLUTION ACCEPTING A PUBLIC SERVICE EASE- <br />MENT FROM ALVIN AND MAXINE BERNARD AND MICHAEL <br />AND PATRICIA GARDEN ACROSS THEIR PROPERTY ON <br />VERVAIS AVENUE <br /> <br />Alvin and Maxine Bernard and Michael and Patricia <br />Garden have voluntarily agreed to convey to the City <br />of Pleasanton a public service easement over the <br />southern ten feet of their property located on <br /> <br />Vervais Avenue, in order to allow for the relocation <br />of utility poles from the narrow Vervais Avenue right- <br />of-way; and <br />the City Council, at its meeting of October 25, 1976, <br />was in receipt of a report from the Director of En- <br />gineering Services, dated October 18, 1976, recommend- <br />ing the acceptance of this easement together with an <br />executed Grant Deed conveying the aforementioned pub- <br />lic service easement; and <br />the Planning Commission has determined that this dedi- <br />cation is in conformance with the General Plan. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. That the public service easement offered to be dedi- <br /> cated to the City of Pleasanton from Alvin and Maxine <br /> Marilyn Bernard and Michael Harold and Patricia Diane <br /> Garden manifested in the Grant Deed, dated September 22, <br /> 1976, for a ten foot wide public service easement <br /> across the southern end of their property on Vervais <br /> Avenue, is hereby accepted and the appropriate City <br /> officials are instructed to take whatever action is <br /> necessary to implement said acceptance. <br /> <br /> <br />
