CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 76-269 <br /> <br /> A RESOLUTION DENYING THE APPEAL OF THE DECISION OF THE <br /> CITY .MANAGER TO FILE A NEGATIVE DECLARATION FOR A PRO- <br /> POSED PROJECT TO CONSTRUCT THREE ONE-STORY COMMERCIAL <br /> SERVICE BUILDINGS ON A 3.3 ACRE SITE ON THE WEST SIDE <br /> OF SANTA RITA ROAD AND SOUTHEAST OF TASSAJARA CREEK <br /> <br /> WHEREAS, the City Manager on October 22, 1976 filed a "Notice of <br /> Intent to File a Negative Declaration" for project <br /> Z-76-202; and <br /> <br /> WHEREAS, said decision was appealed within the time period pro- <br /> vided for in the City of Pleasanton Environmental Impact <br /> Guidelines and Procedures; and <br /> <br /> WHEREAS, on November 22, 1976, a public hearing on said appeal <br /> <br /> was heard by the City Council; and <br /> <br /> WHEREAS, the appellant, and all other interested members of the <br /> public, were afforded an opportunity to speak in favor <br /> and against the appeal; and <br /> <br />WHEREAS, at the conclusion of the public hearing the City Council <br /> deliberated upon the appeal considering the testimony <br /> provided by the public as well as the staff report <br /> of November 16, 1976 and exhibits attached thereto <br /> relating to said appeal. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE AS FOLLOWS: <br /> <br />Section 1. Denies the appeal from the decision of the City <br /> Manager to file a negative declaration for a proposed <br /> project to construct three one-story commercial service <br /> buildings on 3.3 acre site on the west side of Santa <br /> Rita Road and southeast of Tassajara Creek. <br /> <br />Section 2. The City Council determines pursuant to Section 5.4(b) <br /> and Section 5.2 of the City's Environmental Impact <br /> Guidelines and Procedures as set forth in Resolution <br /> 74-24 that the project in question will not have a <br /> significant effect upon the environment. <br /> <br /> <br />
