CITY OF PLEASANTON <br />COUNTy OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-36 <br /> <br />A RESOLUTION APPROVING RENEWAL OF HOLDING <br />TANK FOR UTILITY VAULT CO., INC., 800 VALLEY <br />AVENUE AND AUTHORIZING EXECUTION OF MODIFI- <br />CATION AGREEMENT <br /> <br />WHEREAS, <br /> <br />Utility Vault Co., Inc., has an industrial development <br />at 800 Valley Avenue which is served by a holding tank <br />approved by the City Council on November 1, 1971; and <br /> <br />WHEREAS, <br /> <br />the City Council by Resolution No. 73-140 (A Resolution <br />Establishing a Policy for Holding Tanks in the City of <br />Pleasanton) established a requirement that all holding <br />tanks receive annual approval for continued use; and <br /> <br />WHEREAS, <br /> <br />the City Council at its meeting of February 14, 1977 re- <br />ceived a report from the Director of Engineering Services <br />dated February 3, 1977 regarding the renewal of a hold- <br />ing tank approval for Utility Vault Co., Inc. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section <br /> <br />1. Approves the continued use of a holding tank to serve <br />the property of Utility Vault Co., Inc. at 800 Valley <br />Avenue to November 1, 1977. <br /> <br />Section 2. Directs the City Attorney to prepare a Holding Tank <br /> Agreement in accordance with the conditions 1 and 2 set <br /> forth in the Director of Engineering Services' memorandum <br /> of February 3, 1977. <br /> <br />Section 3. The Mayor is authorized to execute this agreement pre- <br /> pared by the City Attorney on behalf of the City Council. <br /> <br />Section 4. This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON FEBRUARY 14, 1977 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Herlihy, LeClaire, Mercer and <br /> <br />NOES: None Mayor Philco~ <br /> <br />ABSENT: None <br /> <br />APPR VED AS F : <br /> <br />Ke,~.~ ~. ~.~5, ~_, <br />City Attorney <br /> <br /> <br />
