CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 77-35 A RESOLUTION APPROVING RENEWAL OF HOLDING TANK FOR KIE-CON, INC., 32D0 BUSCH ROAD WHEREAS, Kie-Con, Inc. is an industrial development at 3200 Busch Road; and WHEREAS, Kie-Con, Inc. has been using a holding tank to provide sewer services to its property since 1971; and WHEREAS, subsequent to the adoption of the City Council of Resolution No. 73-140 (Establishing a Policy for Holding Tanks in the City of Pleasanton) a Holding Tank Agreement dated September 17, 1975 was entered into between Kie- Con, Inc. and the City of Pleasanton; and WHEREAS, Resolution No. 73-140 requires that holding tanks be re- newed on an annual basis; and WHEREAS, the City Council at its meeting of February 14, 1977 con- sidered a memorandum from the Director of Engineering Services for renewal of the holding tank approval for Kie-Con, Inc. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1. Approves the continued use of a holding tank for Kie- Con, Inc. at 3200 Busch Road to September 17, 1977, sub- ject to the execution of a modification to the agreement of September 17, 1975 by and between the City of Pleasan- ton and Kie-Con, Inc. Section 2. The City Attorney is directed to prepare a modification to the September 17, 1975 Holding Tank Agreement by and between the City of Pleasanton and Kie-Con, Inc. and the Mayor is authorized to sign the same on behalf of the City Council. Section 3. This resolution shall become effective immediately upon its passage and adoption.
