CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-68 <br /> <br />A RESOLUTION APPROVING AN AMENDMENT TO THE JOINT EXERCISE <br />OF POWERS AGREEMENT FOR SOLID WASTE MANAGEMENT AND AUTHOR- <br />IZING EXECUTION BY THE MAYOR, APPROVING THE SOLID WASTE <br />MANAGEMENT FACILITIES PLAN AND AUTHORIZING THE PRO RATA <br />PARTICIPATION BY THE CITY OF PLEASANTON IN THE BUDGET FOR <br />THE SOLID WASTE MANAGEMENT AUTHORITY OF ALAMEDA COUNTY <br /> <br />WHEREAS, <br /> <br />on May 18, 1976 the Board of Supervisors of Alameda <br />County approved a Solid Waste Management Plan for <br />the County of Alameda. This Plan was subsequently <br />approved by a majority of the cities of Alameda County <br />and has been submitted for approval by the State; <br />and <br /> <br />WHEREAS, <br /> <br />the Plan provides for administration of the Plan <br />under provisions of a Joint Exercise of Powers Agree- <br />ment between cities, special districts and the <br />county. Such agreement was approved by all cities, <br />special districts and the county in August and Septem- <br />ber, 1976, and was forwarded to the State on September <br />2, 1976 as a part of the Solid Waste Management Plan. <br />The Solid Waste Management Board was established as <br />the governing body under the Joint Exercise of Powers <br />Agreement; and <br /> <br />WHEREAS, <br /> <br />the Solid Waste Management Plan provides that "a <br />countywide facilities plan will be developed by the <br />Joint Powers Board." The Joint Exercise of Powers <br />Agreement provides that the Solid Waste Management <br />Authority shall have the power to administer and en- <br />force the provisions of the Solid Waste Management <br />Plan but the Agreement itself contains no specific <br />statement of power to develop and approve a Facilities <br />Plan. The Attorney General, in reviewing the sub- <br />mission by the County to the State, has advised that <br />inclusion of such specific statement within the Joint <br />Exercise of Powers Agreement, as well as within the <br />Plan, is necessary to provide authority to the Solid <br />Waste Management Board for approval of the Facilities <br />Plan under provisions of the Government Code; and <br /> <br />WHEREAS, <br /> <br />an amendment to the Joint Exercise of Powers Agreement <br />has been prepared setting forth as a provision of the <br />Agreement, the power of the Solid Waste Management <br />Authority to develop, adopt and revisea FaCilities Plan <br />in accordance with the Solid Waste Management Plan; <br />and <br /> <br />WHEREAS, <br /> <br />said amendment has been recommended by the Solid Waste <br />Management B~ard for approval by parties to the Agree- <br />ment; and <br /> <br /> <br />
