Sec . <br /> <br />Fees. <br /> <br />(a) <br /> <br />(b) <br /> <br /> Article 3 <br />General Responsibilities <br /> <br />Where the City is the Lead Agency, and prepares or <br />contracts for the preparation of EIRs or Negative <br />Declarations for projects to be carried out by any <br />person other than the Lead Agency itself, the City <br />shall charge and collect a reasonable fee from such <br />person or entity, in order to recover all costs in- <br />curred in preparing the EIR or Negative Declaration, <br />as well as the costs of posting, publication and <br />similar costs. <br /> <br />Applicants shall deposit with the Planning <br />Division of the Department of Community Devel- <br />opment a sum determined by the Director df said <br />division, or his designated representative, <br />sufficient to reimburse City for the costs in- <br />curred pursuant to Section (a) above. <br /> <br />If a Negative Declaration or Environmental Im- <br />pact Report is required and is prepared by the <br />City staff, the amount of the deposit shall be <br />the hourly rate of the staff member, or ~embers, <br />involved, plus fringe benefits and overhead costs, <br />based on the City's then current salary schedule, <br />publication costs and other charges associated <br />with the environmental document required to be <br />prepared. A minimum fee for Negative Declarations, <br />as more particularly set forth in the Resolution <br />Establishing Various Fees and Charges for Munici- <br />pal Services, may be established by the Director. <br /> <br />If the environmental document cannot be prepared <br />by City staff, then City shall select an outside <br />firm determined by the Director or his designated <br />representative, to be qualified to prepare the <br />report. The amount of the deposit required of <br />the applicant shall be based upon the estimated <br />cost of consultant's services. The Director shall <br />coordinate with the City Attorney the retention of <br />an outside consultant. <br /> <br />(2) <br /> <br />Any monies remaining on a deposit, after payment <br />of necessary expenses incurred pursuant to these <br />Guidelines shall be returned to the applicant. <br />Any additional monies required shall be paid by <br />the applicant prior to the submittal of the nec- <br />essary environmental document to the approving body. <br /> <br />The City may charge and collect a reasonable fee from <br />members of the public for a copy of an environmental <br />document not to exceed the actual cost of reproducing <br />a copy. <br /> <br />-9- <br /> <br /> <br />
