CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-98 <br /> <br />A RESOLUTION ENCOURAGING THE LIVERMORE-AMADOR VALLEY WATER <br />MANAGEMENT AGENCY BOARD OF DIRECTORS TO USE THE REVENUE <br />BOND LAW OF 1941 TO FINANCE A WASTE WATER DISPOSAL PROJECT <br />AND TO MAKE AMENDMENTS TO THE JOINT EXERCISE OF POWERS <br />AGREEMENT <br /> <br />WHEREAS, <br /> <br />the Livermore-Amador Valley Water Mangement Agency Board <br />of Directors will be holding a meeting on March 30, 1977 <br />in order to select a waste water disposal system for treated <br />effluent in the Livermore-Amador Valley; and <br /> <br />WHEREAS, <br /> <br />the City Council of the City of Pleasanton by Resolution <br />77-94 has endorsed the selection of export Alternative 1B-O <br />(Boehmer Summit - EBDA Interceptor with No Demineralization <br />and Nominal Reuse); and <br /> <br />WHEREAS, <br /> <br />the Revenue Bond Law of 1941, Section 54307.1, authorizes <br />the funding of a project which has been determined by the <br />Regional Water Quality Control Board to be urgently needed <br />for the compliance with the area basin plan selected by <br />said board and to prevent pollution; and <br /> <br />WHEREAS, <br /> <br />the Regional Water Quality Control Board, by Resolution <br />76-17, adopted December 21, 1976, that the LAVWMA project <br />is essential to the basin plan and in order to eliminate <br />pollution; and <br /> <br />WHEREAS, <br /> <br />the citizens of the City of Pleasanton favorably approved <br />the Boehmer Summit - EBDA Interceptor Pipeline which was <br />submitted to them at the November, 1976, election; and <br /> <br />WHEREAS, <br /> <br />the Joint Exercise of Powers Agreement between the agencies <br />which created LAVWMA should be amendedtDreflect the current <br />project and methods of financing said project; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section <br /> <br />1. The City Council urges the Livermore-Amador Valley Water <br />Management Agency to undertake the funding of export Alter- <br />native 1B-O (Boehmer Summit - EBDA Interceptor with No <br />Demineralization and Nominal Reuse) by use of Section 54307.1 <br />of the Government Code (Revenue Bond Law of 1941). <br /> <br />Section <br /> <br />2. The City Council of the City Of Pleasanton supports <br />amendments to the Joint Exercise of Powers Agency Agree- <br />ment creating the Livermore-Amador Valley Water Management <br />Agency to reflect the project to be selected by the LAVWMA <br />Board of Directors and to provide specific authorization <br />for use of the Revenue Bond Law of 1941 and to make neces- <br />sary modifications to said agreement as recommended by the <br /> <br /> <br />
