Miscellaneous. The sewer connections indicated <br />herein for the United Presbyterian Community <br />Church and the City and County of San Francisco, <br />have previously been allocated from, respectively,Com- <br />mercial and Industrial categories. The time limits applicabie <br />to said users shall be the same as the use category <br />within which they received their specific sewer allo- <br />cation. <br /> <br />Section <br /> <br />6. Revocation of Connections. The sewer connection alloca- <br />tions specified in this resolution are made possible as a <br />result of the release of a building connections ban against <br />the Sunol STP by the Regional Water Quality Control Board. <br /> Said release was obtained due to actions authorized by the <br /> City Council and the expenditures of over one-half million <br /> dollars at a sewage treatment plant which will either be re- <br /> placed or phased out within approximately five years. Al- <br /> though the City Council will endeavor to keep the Sunol STP <br /> operating within the standards established by the above <br /> Board, the City Council cannot guarantee that any sewer con- <br /> nections which are allocated will be available indefinitely. <br /> The Regional Water Quality Control Board acts independently <br /> of the City of Pleasanton and its future actions and require- <br /> ments, regarding sewage treatment disposal, are subject to <br /> change. The City Council may revoke allocated unissued <br /> sewer connections or issued sewer connections where substan- <br /> tial improvements have not been performed if the Council de- <br /> termines that the public health, safety, and general welfare ~ <br /> require such revocation of connections. The City Manager, <br /> in consultation with the Director of Public Works~ Chief Build- <br /> ing Inspector and City Attorney, shall determine if substan- <br /> tial improvements exist which would prevent revocation of an <br /> issued sewer connection. The City Manager's determination <br /> shall include but not be limited to, consideration of actual <br /> physical improvements made to each building site for which <br /> a sewer connection has been issued. Revocation Of an issued <br /> sewer connection shall occur when the holder of the sewer con- <br /> nection has been advised, either orally or in writing, of said <br /> revocation by the City Manager, or his designated representa- <br /> tive, and by tendering reimbursement of the appropriate fees. <br /> The same revocation procedure shall apply to any action of <br /> the Regional Board reimposing a connection ban upon the Sunol <br /> STP. <br /> <br />Section 7. Administration. The City Manager and the departments under <br /> his control, together with the City Attorney's office, shall <br /> be responsible for administering this resolution. The City <br /> staff shall endeavor to give an interpretation to the pro- <br /> visions herein which'will most nearly effectuate the intention <br /> of the City Council to provide sewer connections on an equit- <br /> able basis. <br /> <br />Section 8. Fee Forfeiture. In order to prevent the allocation of <br /> permits to individuals who are not ready to proceed with a <br /> project, to the detriment of individuals who are ready to <br /> proceed, a time limitation and forfeiture of fee provision <br /> has been included in each category in Section 5.
