MODIFICATIONS TO LAVWMA <br /> JOINT EXERCISE OF POWERS AGREEMENT <br /> <br /> This modification agreement is entered into this __day of <br /> <br /> , 1977, by and between the CITIES OF LIVERMORE AND <br />PLEASANTON and the VALLEY COMMUNITY SERVICES DISTRICT (all entities <br />hereinafter being referred to as the "Valley Water Interests"). <br /> <br /> WHEREAS, on Or about June 18, 1974, the Valley Water Interests <br />executed a joint powers agreement creating the LIVERMORE AMADOR <br />VALLEY WATER MANAGEMENT AGENCY ("LAVWMA") for the purpose of estab- <br />lishing a water quality management program pursuant to Resolution 71-3 <br />of the Regional Water Quality Control Board, San Francisco Bay Region; <br /> <br /> WHEREAS, at the time of the creation of LAVWMA, a study regard- <br />ing waste water management had been received from Brown and Caldwell <br />Engineers which contemplated a water management program consisting <br />of collection of effluent from the Valley Water Interests and dis- <br />posal in the environs of the Valley, said project being known as <br />the Doolan Canyon Project; <br /> <br /> WHEREAS, subsequent to its formation LAVWMA was required by <br />State and Federal agencies to undertake a review of alternative .~ <br />methods for disposing of effluent from the Valley Water Interests; <br /> WHEREAS, LAVWMA contracted with CH2M Hill for said study which <br /> resulted in the selection of a new project involving the construction <br /> of an export pipeline over Boehmer Summit to facilities of the <br /> East Bay Discharger Authority; <br /> <br /> WHEREAS, pursuant to Paragraph XVI of the original joint powers <br /> agreement, the Valley Water Interests desire to modify said original <br /> <br /> <br />
