CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 77-139 AUTHORIZING THE CITY ATTORNEY TO PARTICIPATE IN LITIGATION REGARDING THE FEDERAL UNEMPLOYMENT COMPEN- SATION ACT AND AMENDING THE CITY ATTORNEY'S BUDGET IN THE AMOUNT OF $%500 TO COVER COSTS WHEREAS, Public Law 94-566 (H.R. 10210) extends the Federal Unemployment Compensation Act to all state and local government employees as of January 1, 1978; and WHEREAS, the new effect of the passage of Public Law 94-566 will be to shift the burden for providing unemployment insurance compensation from the federal government to state and local government; and WHEREAS, if action is not undertaken within the near future to contest the validity of Public Law 94-566, the City will incur an additional continuing financial burden which Congress had undertaken in 1975; and WHEREAS, the National Institute of Municipal Law Officers is attempting to generate support for litigation involving the above legislation; and WHEREAS, the cost to the City of Pleasanton would be approximately $2,500.00; and WHEREAS, the Legal Advocacy Committee of the League of California Cities,City Attorneys section has indicated its support of the proposed NIMLO litigation; and WHEREAS, the City Council at its meeting of May 9, 1977, received and reviewed a report and attachments dated April 21, 1977, regarding Public Law 94-566 Federal Unemployment Compensa- tion Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Authorizes the City Attorney to participate in litigation regarding the Federal Unemployment Compensation Act. Section 2. Amends the City Attorney's Budget in the amount of $2,500.00 to cover costs.
