CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 77-130 DENYING APPEAL OF CITY COUNCIL TO A DECISION OF THE BOARD OF ADJUSTMENT IN APPROVING APPLICATION V-77-3 OF JAMES T. EARLY FOR A VARIANCE WHEREAS, on April 13, 1977, the Board of Adjustment approved Case V-77-3, the application of James T. Early for a variance from the code to allow the construction of two 8-foot fences, one in the side setback and one in the rear set- back of the property located at 7567 Olive Drive; and WHEREAS, the City Council at its meeting of April 25, expressed their wish to review said decision, appealing it; and 1977, therefore, WHEREAS, a public hearing was held on May 9, 1977, at which time City Council received and reviewed a report dated May 2, 1977, from the Director of Planning regarding the appeal of the City Council to a Decision of the Board of Adjust- ment in approving application V-77-2. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Denies the appeal of the City Council to a decision of the Board of Adjustment in approving application V-77-2 of James T. Early for a variance to Section 2-5.38(f) of Article 3, Chapter 2, Title II of the Ordinance Code of the City of Pleasanton to allow the erection of a fence and a wall greater than six feet in height in the side and rear yard of the house located at 7567 Olive Drive, zoning for the property is R-1-6500 (Single-Family Residential) District. Section 2. This resolution shall become effective immediately upon its passage and adoption.
