CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 77-160 A RESOLUTION APPROVING THE EXECUTION OF A QUITCLAIM DEED FOR A CERTAIN RIGHT-OF-WAY AND EASEMENT GRANTED TO THE CITY BY M.G.C. CO., DATED JANUARY 9, 1961 WHEREAS, by deed dated January 9, 1961, a certain easement, over property located at the northeast corner of the intersection of Bonita Avenue with Angela Street, was granted to the City of Pleasanton by M.G.C. Co., a developer of Pleasanton Heights, for the purpose of permitting water to flow and drain from that certain real property known as Tract 2093; and WHEREAS, in consideration for the granting of this easement, City agreed to quitclaim the same when the property that under- lies the easement was subdivided, a Subdivision Map recorded, and/or other adequate drainage facilities provided; and WHEREAS, the Director of Engineering Services, in his memorandum dated June 7, 1977, reported to the City Council at their meeting of June 13, 1977, that the conditions requisite for the City to quitclaim this easement had been met and it is, therefore, in order for the City Council to quitclaim said easement. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RE- SOLVE AS FOLLOWS: Section 1. Authorizes the preparation and execution of a quitclaim deed by the appropriate City officers to Beratlis-Byrd Enterprises, Inc., successors in interest to M.G.C. Co., of that certain right-of-way and easement granted to the City by deed dated January 9, 1961, recorded January 25, 1961 in Reel 252, Image 620 and 621, Official Records of Alameda County, Recorder's Series No. AS10501. Section 2. This resolution shall become effective immediately upon its passage and adoption.
