CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-175 <br /> <br />A RESOLUTION APPROVING EXECUTION OF RIGHT-OF-ENTRY AGREE- <br />MENT WITH OTHO AND ELIZABETH KEEFE <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton will be realigning Valley Avenue <br />and widening Santa Rita Road commencing in August 1977; <br />and <br /> <br />WHEREAS, Otho and Elizabeth Keefe own a portion of the property <br /> on Santa Rita Road which is necessary for widening; and <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton has filed condemnation action <br />against the Keefe's property and has requested an order <br />for possession of said property to be effective July 22, <br />1977; and <br /> <br />WHEREAS, <br /> <br />since State and Federal funds will be used in the con- <br />struction of this project, it is necessary to indicate <br />that the City has the property in order to proceed with <br />the construction of the project; and <br /> <br />WHEREAS, <br /> <br />the City Attorney has been working with Mr. William Gale, <br />Attorney for the Keefes, in order to obtain consent to <br />right-of-entry by the City; and <br /> <br />WHEREAS, the City Attorney prepared a proposed right-of-entry <br /> agreement for execution by the Keefes. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. Authorizes the Mayor to sign a right-of-entry agreement <br /> as proposed by the City Attorney. <br /> <br />Section 2. City Council recognizes that the right-of-entry pro- <br /> visions will not be necessary by July 22, 1977, but is <br /> desirous of obtaining the authority to enter onto the <br /> property at an earlier date should this be possible. <br /> <br />Section 3.
