RESOLUTION NO. 77-"13 '~ <br />Page 3. <br /> <br />section, the maximum allowable differential between <br />projected and actual expenses shall be ONE HUNDRED <br />TWENTY-FIVE THOUSAND DOLLARS ($125,000). The fran- <br />chisee shall not be entitled to a 40%-60% split for <br />any amount in excess of the above. <br /> <br />Franchisee shall advertise its annual spring clean- <br />up program in a manner which the City Manager deter- <br />mines will reasonably apprise the public of the pro- <br />gram. <br /> <br />~ranchisee sh~ll provide two days, one in the spring <br />and one in the fall, of free dumping at the transfer <br />station for lawn and garden trimmings and clippings. <br />The franchisee shall work with the City Manager to <br />determine the appropriate dates upon which to allow <br />free dumping which will be advertised in a manner <br />similar to paragraph j. above. This program shall <br />be monitered so as to assess traffic congestion, <br />noise, and litter resulting from said program. <br /> <br />A discount rate for senior citizens and a rate dif- <br />ferential between resident and non-resident users of <br />the transfer station shall be investigated by fran- <br />chisee and the City Manager and submitted to the City <br />Council for consideration within 60 days of the adop- <br />tion of this resolution. <br /> <br />Section <br /> <br />3. Annually, after the close of franchisee's fiscal year <br /> (March 31) and after the preparation of the audit referred to <br /> in Section 2b, franchisee and the City Manager shall determine <br /> whether a rate increase should be recommended. The amount of <br /> the rate increase submitted to the City Council should take in- <br /> to consideration previous cost and rate experience of the fran- <br /> chisee and projected expense in the incentive program in Sec- <br /> tion 2. <br /> <br />Section 4. Allowable expenses of franchisee for rate-setting purposes <br /> are set forth in Exhibit C, attached hereto and incorporated <br /> herein by reference. The City may amend the allowable ex- <br /> penses in said Exhibit in order to reflect future changes <br /> necessary to provide franchisee with a fair rate of return and <br /> to protect the public from unnecessary rate increase. <br /> <br />Section 5. The City Attorney is authorized and instructed to prepare <br /> any modifications or amendments to the franchisee's contract <br /> and the City's ordinance regulating refuse collection in or- <br /> der to accomplish the purposes of this resolution. <br /> <br />Section 6. This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br /> <br />
