CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77~163 <br /> <br />A RESOLUTION APPROVING A REVISION TO THE GARBAGE RATES <br />CHARGED BY PLEASANTON GARBAGE SERVICE AND PROVIDING A <br />METHOD OF ANALYZING FUTURE INCREASES <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton, pursuant to Article 9, Chapter 2, <br />Title IV of the Ordinance Code, has established an exclu- <br />sive franchise for the collection of refuse in the City; <br />and <br /> <br />WHEREAS, <br /> <br />the City's exclusive franchisee cannot charge collection <br />rates higher than those established by the City Council; <br />and <br /> <br />WHEREAS, <br /> <br />on February 25, 1977, Pleasanton Garbage Service, Inc. (the <br />exclusive franchisee) applied for an increase to its refuse <br />collection rates; and <br /> <br />WHEREAS, said request was referred to the City staff for review and <br /> recommendations; and <br /> <br />WHEREAS, <br /> <br />subsequent to the close of the public hearing the rate in- <br />crease request was continued in order that members of Coun- <br />cil, staff and the franchisee could further review the jus- <br />tification for and data supporting a rate increase; and <br /> <br />WHEREAS, <br /> <br />this matter was again considered by the City Council at its <br />meeting of June 13, 1977, at which time proposed changes to <br />the obligations of franchisee and franchisee's method of <br />justifying rate increases were discussed and recommendations <br />were made for Council's consideration. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. Approves an across-the-board residential, commercial and <br /> transfer station rate increase of 27% effective immediately <br /> and retroactive to April 1, 1977. The breakdown of said in- <br /> crease is more particularly set forth in Exhibit A, attached <br /> hereto and incorporated herein by reference. <br /> <br />Section 2. The franchisee shall undertake and be subject to the fol- <br /> lowing requirements in order to insure that the franchisee <br /> obtains a fair rate of return on investment but provides to <br /> City essential information justifying future rate increases: <br /> <br />Install a cash register at the Transfer Station and <br />institute accounting procedures which, in the opin- <br />ion of the City Manager and City Finance Officer, es- <br />tablish a reliable "audit trail." <br /> <br />Have an annual audited financial statement and oper- <br />ating schedules prepared after March 31 of each year. <br />Franchisee shall select the auditor subject to appro- <br />val by the City Manager.
