RESOLUTION NO. 77-3A9 <br />Page 2. <br /> <br />financing vehicle for said project (Revenue Bond Law <br />of 1941-Without Voter Approval); and <br /> <br />WHEREAS, <br /> <br />the City Council allowed interested members of the audi- <br />ence to make presentations to the City Council on this <br />particular matter and presentations were made by repre- <br />sentatives of Citizens Against Redevelopment, proponents <br />of the referendum from the neighboring City of Livermore, <br />the Executive Director of State Water Resources Control <br />Board, a representative of the Regional Water Quality <br />Control Board - San Francisco Bay Region, Chairman of <br />the Livermore-Amador Valley Water Management Agency and <br />the attorney for Alameda County Water District; and <br /> <br />WHEREAS, <br /> <br />at the close of the public comment, the City Council de- <br />liberated upon the action which it should undertake con- <br />sidering the comments from the public and the remarks of <br />the City Attorney. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. City Council determines that its action of May 23, 1977, <br /> adopting Resolution No. 77-156, was an administrative act <br /> not a legislative act and, therefore, not subject to the <br /> referendum process. <br /> <br />Section 2. <br /> <br />Section <br /> <br /> City Council acknowledges receipt of the report of the <br /> City Clerk certifying the sufficient number of signatures <br /> for referendum purposes but rejects the petitions for <br /> referendum on the basis that the action to be referended <br /> is not subject to the referendum process. <br /> <br />3, This resolution shall become effective immediately upon <br />'its passage and adoption, <br /> <br />THIS RESOLUTION ADOPTED ON JULY 25, 1977 BY THE FOLLOWING VOTE: <br /> <br /> - Brandes, Herlihy, ~eClaire, Mercer and <br />AYES: Councilmembers ~p ~ <br />NOES: None Mayor Philcox ~_~~ ] <br />ABSENT~ None <br />HILCOX <br /> <br />ATTEST: <br /> <br />Doris George, Deputy~rk <br /> <br />APPROVED AS TO FORM: <br /> <br />City Attorney <br /> <br /> <br />
