CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 77-235 <br /> <br />EXCHANGING A THREE FOOT STRIP OF PROPERTY FOR CERTAIN <br />IMPROVEMENTS AND DEDICATIONS BY THE PROPERTY OWNERS <br />OF 480 ST. JOHN STREET <br /> <br />WHEREAS, <br /> <br />on June 13, 1977, the Planning Commission and Design Review <br />Board considered and approved the application of Jim and <br />Jo Betty Allen for construction of an office building to be <br />located at 480 St. John Street; and <br /> <br />WHEREAS, the property is located in the future intersection of <br /> St. John Street and Peters Avenue; and <br /> <br />WHEREAS, the Allens proposed that access to the building be from <br /> Peters Avenue rather than St. John Street; and <br /> <br />WHEREAS, <br /> <br />since that portion of Peters Avenue is not yet constructed <br />and the City does not have plans to contract it in the <br />immediate future, the Aliens propose to finance construction <br />for one-half of the street at this time; and <br /> <br />WHEREAS <br /> <br />in return for this substantial contribution to the City, the <br />Aliens have asked that the City grant them a three (3) foot <br />wide strip of land lying between the Peters Avenue right-of- <br />way and their property, which they would include in their <br />design as landscaping; and <br /> <br />WHEREAS, <br /> <br />as additional consideration, the Allens have offered to <br />grant to the City a small parcel of land needed by the <br />City for development of the Peters Street right-of-way; <br />and <br /> <br />WHEREAS, <br /> <br />in order to process a request for property disposition, the <br />Planning Commission must first report to the City Council <br />that the proposed disposition of City property is in con- <br />formance with the General Plan; and <br /> <br />WHEREAS, on July 10, 1977, the Planning Commission passed a resolution <br /> to that effect; and <br /> <br />WHEREAS, <br /> <br />the City Council at its meeting of August 23, 1977, received <br />and reviewed a report dated August 17, 1977, from the Deputy <br />City Attorney regarding the above-mentioned matter. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br /> <br />
