CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-244 <br /> <br />A RESOLUTION APPROVING EXECUTION OF A CONTRACT WITH KAISER <br />INDUSTRIES CORPORATION, SAND AND GRAVEL DIVISION <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton and Kaiser Industries Corporation, <br />Sand and Gravel Division entered into a contract of <br />February 7, 1972 whereby Kaiser was to reimburse the City <br />of Pleasanton for the City's share of costs for safety <br />devices at the Southern Pacific Railroad Crossing at <br />Busch Road; and <br /> <br />WHEREAS, <br /> <br />Kaiser had conveyed to the City for street purposes <br />certain properties located to the east and the west of <br />Busch Road; and <br /> <br />WHEREAS, <br /> <br />City and Kaiser are interested in finalizing the actual <br />cost to Kaiser for the improvements at the Busch Road <br />crossing as well as obtaining to the City in fee the <br />properties to the east and west of said crossing; and <br /> <br />WHEREAS, <br /> <br />the City Council received a report of September 8, 1977 <br />from the City Attorney together with numerous attachments <br />thereto giving background and information regarding the <br />relationship between the City and Kaiser Industries in re- <br />gard to the above matters; and <br /> <br />WHEREAS, the City Council deliberated upon the information provided <br /> by the City Attorney at its meeting of September 13, 1977. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. The City Council authorizes the Mayo~ subject to approval <br /> by the City Attorney, to enter into an agreement with Kaiser <br /> Industries whereby Kaiser Industries will convey to the City <br /> of Pleasanton $22,500 in consideration of safety devices at <br /> the Southern Pacific - Busch Road Railroad Crossing as well <br /> as fee title to the properties to the east and west of said <br /> crossing which are used by the City of Pleasanton for street <br /> purposes and City will release Kaiser Industries from its <br /> obligations under the February 7, 1972 agreement. <br /> <br />Section 2. This resolution shall become effective immediately upon its <br /> passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON SEPTEMBER 1~, 1977 BY THE FOLLOWING VOTE: <br />AYES: Councilmembers - Brandes, HerliI y, LeClaire, er and Mayor <br /> <br /> City Attorney <br /> <br />Philcox <br /> <br /> <br />
