CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-270 <br /> <br />A RESOLUTION APPROVING FINAL MAP AND IMPROVEMENT PLANS <br />FOR TRACT 3359 CREEK'S BEND, MORRISON HOMES <br /> <br />WHEREAS, Morrison Homes has filed a final map for Tract 3359; and <br /> <br />WHEREAS, <br /> <br />Morrison Homes has executed the necessary Subdivision <br />Improvement Agreement and filed the necessary bonds <br />related thereto; and <br /> <br />WHEREAS, <br /> <br />the City Engineer has certified to the City Council that <br />final map for Morrison Homes, Tract 3359 (Creek's Bend) <br />conforms to the tentative map and the requirements of the <br />Subdivision Map Act in the City's Subdivision Ordinances; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. Approves the final map and improvement plans for Tract 3359, <br /> Creek's Bend and authorizes the recordation of the same. <br /> <br />Section 2. Authorizes the mayor, subject to approval by the City Attorney <br /> to execute a Subdivision Improvement Agreement with Morrison <br /> Homes. <br /> <br />Section 3. Directs the City Attorney to include in the Subdivision <br /> Improvement Agreement a provision relating to the fact that <br /> Morrison Homes is aware of the Pleasanton Safe Streets <br /> Association Litigation and require the City Council to <br /> proceed with the approval of this final map in spite of said <br /> litigation. <br /> <br />Section 4. This resolution shall become effective immediately upon its <br /> passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON OCTOBER 1 , 1977 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, He lihy, LeClaire and Mayor Philcox <br />ATTEST: RO ERR C.
