CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-282 <br /> <br />A RESOLUTION APPROVING RENEWAL OF HOLDING TANK FOR <br />UTILITY VAULT CO., INC., 800 VALLEY AVENUE AND AUTH- <br />ORIZING EXECUTION OF MODIFICATION AGREEMENT <br /> <br />WHEREAS, <br /> <br />Utility Vault Co., Inc. has an industrial development at <br />800 Valley Avenue which is served by a holding tank approved <br />by the City Council on November 1, 1971; and <br /> <br />WHEREAS, <br /> <br />the City Council by Resolution No. 73-140 (A Resolution Es- <br />tablishing a Policy for Holding Tanks in the City of Pleas- <br />anton) established a requirement that all holding tanks re- <br />ceive annual approval for continued use; and <br /> <br />WHEREAS, <br /> <br />the City Council at its meeting of October 25, 1977 received <br />a report from the Director of Engineering Services dated <br />October 18, 1977 regarding the renewal of a holding tank ap- <br />proval for Utility Vault Co., Inc. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. Approves the continued use of a holding tank to serve the <br /> property of Utility Vault Co., Inc. at 800 Valley Avenue to <br /> November 1, 1978. <br /> <br />Section 2. Directs the City Attorney to prepare a Holding Tank Agree- <br /> ment in accordance with the conditions 1 and 2 set forth in <br /> the Director of Engineering Services' memorandum of October 18, <br /> 1977. <br /> <br />Section 3. The Mayor is authorized to execute this agreement prepared <br /> by the City Attorney on behalf of the City Council. <br /> <br />Section 4. This resolution shall become effective immediately upon its <br /> passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON OCTOBER 25, 1977 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Herlih , LeClaire, Mercer and <br /> <br />NOES: None Mayor Philcox <br /> <br /> RT C.
