CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION N0. 77-320 <br /> <br />A RESOLUTION APPROVING APPLICATION FOR A PERMIT FOR <br />A HOLDING TANK FOR EARL ADAMS AT BUILDING #3, 3657 <br />OLD SANTA RITA ROAD, PLEASANTON <br /> <br />WHEREAS, <br /> <br />on June 8, 1977, the Design Review Board gave design review <br />approval to construct a third building for commercial service <br />purposes at 3657 Old Santa Rita Road; and <br /> <br />WHEREAS, <br /> <br />it is necessary for Mr. Adams to obtain City Council <br />approval for a private sewage system, and an application <br />has been submitted to have this development served by an <br />existing holding tank; and <br /> <br />WHEREAS, staff recommends the use of the existing holding tank <br /> rather than construction of a new one. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF TItE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves use of a holding tank by Earl Adams at Building <br /> #3, 3657 Old Santa Rita Road, subject to the following <br /> conditions: <br /> <br />That the use of the existing holding tank for this <br />development be considered satisfactory only so long <br />as the parcel is maintained as a single parcel of <br />land. <br /> <br />That the property owner enter into a Standard <br />Holding Tank Agreement with the City for this <br />proposed development, modified as necessary to <br />provide for the automatic termination of this <br />approval in the event this building site were <br />to be split from the site containing the holding <br />tank and be transferred to a different owner than <br />the site containing the holding tank. Execution <br />of this agreement by proper city officials should <br />be authorized by City Council approval of this <br />application. <br /> <br />Section 2. This resoltuion shall become effective immediately upon <br /> its passage and adoption. <br /> <br />III <br /> <br /> <br />
