CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 77-302 A RESOLUTION APPROVING A REQUEST FROM CHRIS BERATLIS FOR AN EXCEPTION TO THE REQUIREMENTS OF SECTION 2-16.22 OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON RELAT- ING TO CONNECTIONS TO THE WATER SYSTEM OF THE CITY OF PLEASANTON WHEREAS, Mr. Chris Beratlis is the owner of a one acre parcel of property located in the unincorporated area of Alameda County immediately north of Crellin Road, the southern half of which constitutes the northern most boundary of the City of Pleas- anton; and WHEREAS, Mr. Beratlis m~e'application to the City of Pleasanton for the installation of temporary water facilities in order to serve said one acre parcel; and WHEREAS, the City Council, pursuant to Section 2-16.26, Article 2 to the Ordinance Code of the City of Pleasanton, held a public hearing in order to consider an exception to Section 2-16.22 of said code requiring the construction of all in-tract and perimeter facilities necessary to serve the area provided water services; and WHEREAS, at said public hearing, Mr. Beratlis and any other member of the public was afforded an opportunity to present evidence to the City Council regarding the requested exception to the re- quirements of Section 2-16.22 of the Ordinance Code; and WHEREAS, upon close of the public hearing, the City Council deliberated upon the information provided at the public hearing together with the Staff Report from the Director of Engineering Services of November 3, 1977 to which was an appended Draft Agreement if the City Council should grant the request. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1. Authorizes the Mayor, subject to the approval by the City Attorney, to enter into an agreement with Mr. Chris Beratlis in order to provide temporary water services to a one acre parcel of property located in the unincorporated area of Alameda County owned by Mr. Beratlis, which is immediately north of the City boundary line on Crellin Road, and grant- ing a waiver to Section 2-16.22 of the Ordinance Code of the City of Pleasanton. Section 2. The City Council intends to authorize the staff to investi- gate the establishment of a policy of the City Council with re- spect to the provision of water services to properties outside of the incorporated limits of the City of Pleasanton and will not consider further requests for exceptions to Section 2-16.22 of the Ordinance Code until such time that a policy is estab- lished.
