EASEMENT AGREEMENT <br /> <br /> This Easement Agreement (hereinafter referred to as "Agreement") is entered into <br />this ~ day of 2000, by and between and the City ofPleasanton, a <br />municipal corporation ("City") and the Alameda County Flood Conlrol and Water <br />Conservation District ("District"). <br /> <br />RECITALS <br /> <br /> A. The City is purchasing from the Prudential Insurance Company of America <br />("Prudential") two parcels of property for the possible expansion of an existing City park <br />and to provide future right-of-way for the widening of the intersection of Stoneridge <br />Drive at Santa Rita Road. <br /> <br /> B. The District desires to construct, operate, and maintain facilities on such <br />property for the District's Mocho Well Project. <br /> <br /> C. The parties desire to have the District provide a financial contribution to the <br />City for a portion of the cost of such property, and the City will then grant the District <br />easements for the Mocho Well Project. <br /> <br /> NOW THEREFORE, in exchange for valuable consideration, the receipt of which <br />is hereby acknowledged, the parties agree as follows: <br /> <br />1. City Acquisition of Pronertv. <br /> <br />The City has agreed to buy from Prudential for Two Hundred and Ten Thousand Dollars <br />($210,000.00) two (2) parcels; the first parcel is approximately 1.93 acres located <br />southerly of Stoneridge Drive (commonly known as APN 946-3325-95-02), and the <br />second parcel is approximately 0. 11 acres located northerly of Stoneridge Drive <br />(commonly known as APN 946-3325-95-03), both parcels located in Alameda County, <br />California, described more particularly in the attached Exhibit 1, incorporated herein by <br />reference (the "Property"). <br /> <br />2. Citv Grant of Easement to District: Restrictions on Use. <br /> <br />The City shall grant to the District easements for the purpose of constructing, operating, <br />and maintaining two (2) well facilities and related pipelines on the Property. The grant of <br />easements shall be generally in the form set forth in the attached Exhibit 2, incorporated <br />herein by reference (the "Easements"). Such easements shall be recorded immediately <br />upon the City's acquisition of the Property. <br /> <br />The District shall be prohibited from using the well facilities and related pipelines on the <br />Property for the purpose of injection of treated wastewater into the groundwater basin, <br />unless agreed upon by the City.
