CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION N0.78-20 <br /> <br />A RESOLUTION DENYING THE APPEAL OF MOBIL OIL COPORATION <br />FORM A DECISION OF THE PLANNING COMMISSION DENYING CASE <br />RZ-77-15. <br /> <br />WHEREAS , <br /> <br />Mobil Oil Corporation made application to rezone its <br />property at 5311 Hopyard Road from the C-F (Commercial <br />Freeway) District to the C-S (Commercial Service) District; <br />and <br /> <br />WHEREAS, <br /> <br />the Planning Commission, at its meeting of November 9, 1977 <br />received a staff report on the application, an environmental <br />impact report prepared for the project and testimony from <br />the applicant and the community; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission entered an adopted Resolution 1583 <br />attached hereto and incorporated by reference finding the <br />EIR complete and finding no significant impacts of the pro- <br />posed project; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission entered and adopted Resolution 1584 <br />attached hereto and incorporated by reference herein, denying <br />the rezoning request and development plan, and <br /> <br />WHEREAS, the applicant requested a hearing before the City Council <br /> on his denied application; and <br /> <br />WHEREAS, a public hearing on the rezoning request and EIR was set <br /> for January 24, 1979; and <br /> <br />WHEREAS, <br /> <br />the City Council, at its January 24, 1978, meeting received <br />a staff report, environmental impact report and at a public <br />hearing took testimony from the applicant, his representatives <br />and staff and the public; and <br /> <br />I~HEREAS, the City Council made the finding that the project would have <br /> a significant impact on the environment. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. Denies the appeal of Mobil Oil Corporation from a decision <br /> of the Planning Commission denying Case RZ-77-15, the appli- <br /> cation of Mobil Oil Corporation to rezone the property located <br /> at 5311 Hopyard Road, and incorporates by reference, the find- <br /> ings set forth in Resolutions 1583 and 1584 of the Planning <br /> Commission denying Case RZ-77-15 filed by Mobil Oil Corporation. <br /> Said resolutions are incorporated herein Uy reference and <br /> attached hereto as Exhibits A and B. <br /> <br />III ' <br /> <br /> <br />
