CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 78-17 <br /> <br />A RESOLUTION APPROVING RENEWAL OF HOLDING TANK FOR EARL ADAMS <br />BUILDING NO. 2, AT 3663 OLD SANTA RITA ROAD. <br /> <br />WHEREAS, Earl Adams has been using a holding tank to provide sewer <br /> services to his property at 3663 Old Santa Rita Road; and <br /> <br />WHEREAS, <br /> <br /> subsequent to the adoption of the City Council of Resolution <br />No. 73-140 (Establishing a Policy for Holding Tanks in the City <br />of Pleasanton) a Holding Tank Agreement dated February 28, 1977, <br />was entered into between Mr. Adams and the City of Pleasanton <br />permitting him to use a holding tank to provide sewer services <br />for his property, subject to annual renewal of the permit based <br />upon Mr. Adams compliance with all the terms and conditions set <br />forth in that agreement; and <br /> <br />WHEREAS, the City Council at its meeting of January 24, 1978, considered <br /> the request of Mr. Adams for a holding tank to serve the <br /> property known as Building #2, 3663 Old Santa Rita Road. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section <br /> <br />1. Approve the continued use of the holding tank for the <br />property at 3663 Old Santa Rita Road, subject to the terms and <br />conditions of the original approval and also subject to the <br />following conditions: <br /> <br />1. That the holding tank be pumped out (emptied) at <br />time every 14 days or in accordance with the current <br />concerning the frequency of pumping. <br /> <br />least one <br />City policy <br /> <br />2. That renewal request, together with the appropriate renewal <br />fee, be transmitted to the City at least one month prior to <br />expiration date of January 24, 1979. <br /> <br />Section <br /> <br />2. The City Attorney is directed to prepare a renewal holding <br />tank agreement by and between the City of Pleasanton and Adams <br />and the Mayor is authorized to sign the same on behalf of the <br />City Council. <br /> <br />Tile <br /> <br />Section 3.
