CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 78-47 <br /> <br />GRANTING APPEAL OF JOSEPH MADDEN TO A DECISION OF <br />THE PLANNING COMMISSION REQUIRING AN ENVIRONMENTAL <br />IMPACT REPORT IN CONJUNCTION WITH CASE RZ-77-16 <br /> <br />WHEREAS, <br /> <br />the Planning Commission, at its meeting of February 8, <br />1978, held a public hearing regarding the application to <br />prezone 13.6 acres of land located on the north side of <br />Stanley Boulevard between the Western Pacific and Southern <br />Pacific Railroad tracks to C-S (Commercial Services) <br />District; and <br /> <br />WHEREAS, <br /> <br />after considering the staff report and taking public <br />testimony on the matter, the Commission found that the <br />project might have a significant adverse impact on the <br />Environment and that an Environmental Impact Report <br />should be prepared; and <br /> <br />WHEREAS Mr. Joseph Madden is appealing that decision of the <br /> Planning Commission; and <br /> <br />WHEREAS <br /> <br />the City Council at their meeting of March 1, 1978, <br />received and reviewed a report dated February 21, 1978, <br />from the Director of Planning and Community Development <br />and took public testimony regarding the above-mentioned <br />matter; and <br /> <br />WHEREAS <br /> <br />the negative declaration attached to that report indicates <br />that there are no significant adverse impacts of the project <br />which cannot be mitigated. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Grants the appeal of Joseph Madden to a decision of the <br /> Planning Commission requiring an Environmental Impact Report <br /> in conjunction with Case RZ-77-16, an application to prezone <br /> to C-S (Commercial Service) 13.5 acres of land located on <br /> the north side of Stanley Boulevard between the Western <br /> Pacific and Southern Pacific Railroad tracks. <br /> <br />Section 2. Retains the proposed mitigation measure of limiting <br /> increase in traffic to 10% over present flow from the <br /> site. <br /> <br />Section 3. This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />III <br /> <br /> <br />
