WHEREAS, WHEREAS, WHEREAS, WHEREAS WHEREAS, WHEREAS, WHEREAS, CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 78-46 A RESOLUTION OF THE CITY COUNCIL DENYING THE APPEAL OF ROBERT Jo MYERS FROM A DECISION OF THE PLANNING COMMISSION DENYING A PUD ZONING AND A DEVELOPMENT PLAN FOR A PROPOSED ll9-UNIT RETIREMENT FACILITY. Robert J. Myers made application to rezone a 12.7 acre site located immediately south of the terminus of Las Lomitas Drive and east of Pleasanton School from the A (Agricultural) District to the PUD (Planned Unit Development - Medium Density Residential) District and to receive approval of a development plan for the site showing a ll9-unit limited care retirement facility; and the Planning Commission, at its meeting of January 11, 1978, received a staff report on the application, an environmental impact report prepared for the project and testimony from the applicant and the community; and the Planning Commission entered and adopted Resolution 1607, attached hereto and incorporated by reference finding the EIR complete and finding significant impacts of the proposed project; and the Planning Commission entered and adopted Resolution 1608, attached hereto and incorporated by reference herein, denying the rezoning request and development plan; and the applicant requested a hearing before the City Council on his denied application; and a public hearing on the rezoning request and EIR was set for March 1, 1978; and the City Council, at its March 1, 1978, meeting received a staff report, environmental impact report and at a public hearing took testimony from the applicant, his representative and staff and the public; and WHEREAS, the City Council made the finding that the project would have a significant impact on the environment~ NOW, THEEFOE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1o Denies the appeal of Robert J. Myers from a decision of the Planning Commission denying a PUD zoning and development plan for a proposed ll9-unit retirement facility, and incor- porates by reference, the findings set forth in Resolutions 1607 and 1608 of the Planning Commission denying PUD-77-7 filed by Mr. Myers. Said resolutions are incorporated herein by reference and attached hereto as Exhibits A and B.
