CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 78-139 <br /> <br />A RESOLUTION APPROVING WORKERS' COMPENSATION <br />SELF-INSURANCE FOR THE CITY OF PLEASANTON <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton is currently a member of the <br />State Compensation Fund for its Workers' Compensa- <br />tion Insurance coverage; and <br /> <br />WHEREAS, the insurance premiums paid to the State Compensation <br /> Fund for this year, will be ap roximately $175,000 <br /> and will probably increase to ~200,000 in 1978-79, or <br /> approximately 2.5% of the total operating budget; and <br /> <br />WHEREAS, the cost of premiums makes self-insurance for Workers' <br /> Compensation economically feasible; and <br /> <br />WHEREAS, <br /> <br />if this City chooses to become self-insured, it must <br />notify the State Compensation Fund of that decision <br />before June 30, 1978, when the City's current policy <br />expires, in order to avoid penalties; and <br /> <br />WHEREAS, <br /> <br />the City staff has presented a self-insurance program <br />for Workers' Compensation, which includes the use of a <br /> <br />insurance policy for claims over to a maximum <br />of $1,000,000 per occurrence; and <br /> <br />WHEREAS, on May 23, 1978, a hearing was held on the issues of <br /> Workers' Compensation self-insurance; and <br /> <br />at that meeting a report on self-insurance was delivered <br />by the City staff and by the City's insurance agent, Ben <br />Fernandez; and <br /> <br />'WHEREAS, <br /> <br />it appears that the City can provide Workers' Compensation <br />insurance adequately without belonging to State Compensa- <br />tion Fund. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. To authorize staff to notify State Compensation Fund that <br /> Pleasanton does not plan to renew the Workers' Compensation <br /> insurance policy that expires June 30, 1978. <br /> <br />Section 2. To approve the proposal of Employers' Self-Insurance Ser- <br /> vice, Inc. (ESIS, INC.) to administer the City's self-insurance <br /> program at an annual cost of $4,188.00 for the first seventy- <br /> five (75) claims handled per year, plus $56.00 for each ad- <br /> ditional claim. <br /> <br /> <br />
