WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 78-133 <br /> <br />A RESOLUTION UPHOLDING THE APPEAL OF FRANK C. BRANDES, <br />OF THE PLANNING COMMISSION DECISION TO MODIFY PLANNING <br />COMMISSION RESOLUTION NO. 1527. <br /> <br />JR. <br /> <br />the Planning Commission on June 8, 1977, approved a Condi- <br />tional Use Permit for Mark Lawrence's Skateworld project to <br />be constructed on Johnson Industrial Drive; and <br /> <br />the Planning Commission included as a condition to that <br />approval the following: <br /> <br />11. <br /> <br />The applicant shall enter into a hold harmless agree- <br />ment, acceptable to the City Attorney, agreeing to <br />defend and hold harmless the City of Pleasanton, its <br />employees and officers from any and all liability <br />arising out of injuries occurring on account of <br />applicant's use of subject site; said agreement shall <br />be secured by either: <br /> <br />(a) <br /> <br />The applicant naming the City of Pleasanton <br />as an additional insured on applicant's <br />liability policy with limits of at least one <br />million dollars ($1,000,000) per injury <br />(applicant shall file with the City a Cer- <br />tificate of Insurance so indicating); or <br /> <br />(b) <br /> <br />Applicant shall file with the City of <br />Pleasanton, a certificate of insurance <br />indicating Contractual Liability coverage <br />of at least the limits indicated above. <br /> <br />Applicant's insurer shall also notify the City ten (10) <br />days prior to cancellation. This Conditional Use Permit <br />shall be suspended at any time applicant's insurance, <br />as it pertains to the City, lapses or is cancelled, and <br />no use shall be made of the property during such suspen- <br />sion; <br /> <br />and <br /> <br />Mr. Lawrence on February 21, 1978 requested that the condition <br />be modified to permit him to provide insurance for five hun- <br />dred thousand dollars ($500,000) rather than one million dol- <br />lars ($1,000,000); and <br /> <br />the Planning Commission considered his request at their <br />meeting of April 19, 1978 and concluded that such a change <br />was a major modification of the Conditional Use Permit <br />requiring a public hearing; and <br /> <br />WHEREAS, the Planning Commission also considered Mr. Lawrence's request <br /> that the language of the condition be modified to limit the <br /> <br /> <br />
