CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 78-122 <br /> <br />APPROVAL OF SETTLEMENT AGREEMENT BETWEEN PLEASANTON <br />SAFE STREETS ASSOCIATION vs. MORRISON HOMES AND CITY <br />OF PLEASANTON <br /> <br />WHEREAS, <br /> <br />the Pleasanton Safe Streets Association (PSSA) filed a <br />lawsuit against the City of Pleasanton and Morrison Homes <br />challenging the adequacy of the Environmental Impact Report <br />prepared with respect to the Creek's Bend Project of Morri- <br />son Homes; and <br /> <br />WHEREAS, the above-mentioned lawsuit questioned the safety of the <br /> Del Valle Parkway; and <br /> <br />WHEREAS, PSSA did not prevail at trial and appealed the decision; and <br /> <br />WHEREAS, <br /> <br />an agreement has been reached between all parties which will <br />settle the litigation, and provide for the improvement of <br />Del Valle Parkway, and the Creek's Bend project; and <br /> <br />WHEREAS, <br /> <br />at its meeting of May 9, 1978, the City Council received <br />a report from the City Manager and reviewed the proposed <br />settlement agreement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves the settlement agreement between Pleasanton <br /> Safe Streets Association vs. Morrison Homes and City of <br /> Pleasanton. <br /> <br />~ection 2. Authorizes the Mayor to <br /> the City. <br /> <br />sign the agreement on behalf of <br /> <br />Section 3. This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON MAY 9, 1978, BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Butler, Kephart, Wood and <br /> Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: <br /> <br />ATTEST: ~RCER, MAYOR <br />Clay on E.
