CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 78-178 A RESOLUTION APPROVING RENEWAL OF HOLDING TANK PERMIT FOR EXXON COMPANY AT 2991 HOPYARD ROAD AND AUTHORIZING EXECUTION OF MODIFICATION OF AGREEMENT DATED FEBRUARY 28, 1977 WHEREAS, Exxon Company receives sewage service for its service station at 2991 Hopyard Road, Pleasanton, from a sewage holding tank; and WHEREAS, said holding tank was approved by the City Council on February 28, 1977, pursuant to Resolution No. 73-140 (A Resolution Establishing a Policy for Holding Tanks in the City of Pleasanton); and WHEREAS, Resolution No. 73-140 requires that authorization to con- tinue the use of a facility on a holding tank must occur annually; and WHEREAS, the City Council at its meeting of July 11, 1978, received a report from the Director of Engineering Services recom- mending renewal of a holding tank permit for the Exxon Company for their facility at 2991 Hopyard Road; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1. Authorizes the extension of the approval for use of a holding tank by Exxon Company at 2991 Hopyard Road to July 17, 1979, subject to the terms and conditions of the current holding tank agreement and, in addition, subject to the following conditions: (1) That the holding tank be pumped out (emptied) at least one time every 14 days or in accordance with the current City policy concerning the frequency of pumping. (2) That renewal request, together with appropriate renewal fee, be transmitted to the City at least one month prior to expiration date of July 17, 1979. Section 2. This resolution shall take effect immediately.
