CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION N0. 78-175 <br /> <br />A RESOLUTION APPROVING A REQUEST FROM ~fit. TED MYERS <br />FOR A HOLDING TANK FOR AN OFFICE BUILDING COMPLEX ON <br />MOHR AVENUE <br /> <br />WHEREAS, <br /> <br />Mr. Ted Myers is the owner of a certain piece of property <br />located on a 3.1 acre parcel of land on Mohr Avenue in <br />Pleasanton; and <br /> <br />WHEREAS, <br /> <br />Mr, Ted Myers (P & M Developers) has requested approval of <br />a private sewage disposal system to serve the above property <br />since it is not located near a sewage disposal line to the <br />Sunol Sewage Treatment Plant; and <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of June 27, 1978, considered <br />Mr. Ted Myers' request together with a staff report of <br />June 22, 1978 prepared by the Director of Engineering Ser- <br />vices. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. <br /> <br /> Approves the request by Mr. Ted Myers (P & M Developers) <br />received June 27, 1978 for a holding tank to serve the pro- <br />perty located on a 3.1 acre parcel of land on Mohr Avenue, <br />subject to the following conditions: <br /> <br />That the property owner enter into a Standard Holding <br />Tank Agreement with the City prior to issuance of a <br />building permit for this development. Execution of <br />this agreement by the proper City officials is hereby <br />authorized by approval of this application. <br /> <br />That the property owners acknowledge in writing their <br />understanding of the probably magnitude of monthly <br />pumping charges and that they are able and willing to <br />meet this commitment as long as the holding tank is <br />necessary. <br /> <br />3. That approval be granted for a one-year period. <br /> <br />That the property owners acknowledge in writing, prior <br />to issuance of a building permit, their understanding <br />of the time limit of this approval and that City Council <br />is not obligated to automatically grant approval for <br />continued use of the holding tank. <br /> <br />That the holding tank be pumped out at least one time <br />every fourteen (14) days if monthly volume exceeds 2,000 <br />gallons. <br /> <br /> <br />
