~ CITY OF PLEASANTON ~ <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> RESOLUTION NO. 78-191 <br /> <br />A RESOLUTION OF THE CITY COUNCIL REQUESTING <br />LEGISLATIVE ACTION ON THE VOLUNTEER~UNITY. <br /> <br />WHEREAS , <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />Councilman Walter Wood has submitted a proposed resolution <br />which would grant legislative immunity to volunteers of <br />public agencies by requesting State Legislature to enact <br />such legislation; and <br /> <br />the City of Pleasanton has received many requests from <br />the citizens desiring to offer their services on a <br />voluntary basis; and <br /> <br />the City is concerned that such volunteers would be unduly <br />exposed to tort liability for their community activities; <br />and <br /> <br />WHEREAS, the immunity from tort liability which is available to public <br /> employees, under certain circumstances, ought to be avail- <br /> able to volunteers acting with the official sanction of the <br /> agency for which the services are being offered and con- <br /> ducted; and <br /> <br />WHEREAS, the indemnification provided to public employees ought to <br /> be available to officially sanctioned volunteer workers <br /> when acting in the same capacities as public employees. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. That the State Legislature be urged to enact an amendment <br /> to the Tort Claims Act which would grant volunteers of public <br /> agencies with the official sanction of those agencies the <br /> same~unity and indemnification from tort liability as <br /> public employees. <br /> <br />Section 2. This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br />THIS RESOLUTION WAS ADOPTED ON JULY 25, 1978 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Kephart, Wood and Vice Mayor Brandes <br />NOES: None <br /> <br />ATTEST: <br /> <br /> 1 E.
