CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 78-188 <br /> <br />A RESOLUTION DENYING THE APPEAL OF JOSEPH MADDEN <br />TO A DECISION OF THE BOARD OF ADJUSTMENT DENYING <br />CASE V-78-13, REQUEST A VARIANCE FROM THE REQUIRE- <br />MENTS OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON <br /> <br />WHEREAS, <br /> <br />Joseph Madden made a request for a variance from the re- <br />quirements of the Ordinance Code of the City of Pleasanton <br />(case no. V-78-13) to allow the installation of an off-site <br />"For Lease" sign on property located on the Northwest side <br />of Santa Rita Road South of 1-580 Highway; and <br /> <br />WHEREAS, <br /> <br />the Board of adjustment, at its meeting of June 14, 1978, <br />received a staff report on Mr. Madden's application for a <br />variance as well as testimony from the applicant and the <br />community; and <br /> <br />~HEREAS, <br /> <br />the Board of Adjustment denied the case on 6/14/78 because <br />they did not feel that all findings required for the grant- <br />ing of a variance could be made; and <br /> <br />WHEREAS, <br /> <br />the applicant requested a hearing before the City Council <br />on its denied application; and <br /> <br />WHEREAS, a public hearing on the request for a variance (case no. <br /> V-78-13) was held on July 25, 1978; and <br /> <br />WHEREAS, <br /> <br />the City Council, at its July 25, 1978, meeting received a <br />staff report, environmental impact report and at a public <br />hearing took testimony from the applicant, his represen- <br />tative and staff and the public; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. <br /> <br /> Denies the appeal of Joseph Madden from a decision of the <br />Board of Adjustment denying case V-78-13 plan for a proposed <br />off-site "For Lease" sign and incorporates by reference the <br />findings set forth in the Report of ~eBoard of Adjustment, <br />attached hereto as Exhibit A. <br /> <br />Section 2. This resolution shall be effective immediately upon its <br /> passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON JULY 25, 1978 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers Brandes and Kephart <br />NOES: Councilmember - Wood <br />ABSENT: Councilmembers Butler an~~~~ <br />ATTEST: <br /> <br />Doris George.
