CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> RESOLUTION NO. 78-203 <br />A RESOLUTION APPROVING A HOLDING TANK PERMIT FOR <br />JOSEPH MADDEN ON HIS PROPERTY ON THE WEST SIDE <br />OF OLD SANTA RITA ROAD <br /> <br />WHEREAS, <br /> <br />Mr. Joseph Madden has received design review approval to <br />construct three buildings on the west side of Old Santa <br />Rita Road; and <br /> <br />WHEREAS, <br /> <br />before Mr. Madden can proceed with his project it will be <br />necessary for him to obtain City Council approval for a <br />private sewage disposal system to serve these buildings; <br />and <br /> <br />WHEREAS, <br /> <br />a request has been received from Mr. Madden for approval <br />of a 10,000 gallon sewage holding tank to serve this pro- <br />posed development; and <br /> <br />WHEREAS, <br /> <br />this request has been reviewed by Engineering staff and <br />found to be in conformance with the City's adopted policy <br />concerning the use of holding tanks for sewage disposal; <br /> <br />NOW, THEREFORE, THE CITY CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1. Approves a holding tank permit for Mr. Joseph Madden <br /> to serve his proposed development of three buildings on <br /> the west side of Old Santa Rita Road, subject to the follow- <br /> ing conditions: <br /> <br />(1) <br /> <br />That the property owner enter into a standard hold- <br />ing agreement with the City prior to issuance of a <br />building permit for this development. <br /> <br />(2) <br /> <br />That the property owners acknowledge in writing <br />their understanding of the probable magnitude of <br />monthly pumping charges and that they are able and <br />willing to meet this commitment as long as the hold- <br />ing tank is necessary. <br /> <br />(3) <br /> <br />That approval be granted for a one-year period <br />expiring August 8, 1979, and that application for <br />renewal be submitted to the City, together with <br />appropriate renewal fee, at least one month prior <br />to expiration date of August 8, 1979. <br /> <br />(4) <br /> <br />That property owners acknowledge in writing, prior <br />to issuance of a building permit, their understand- <br />ing of the time limit of this approval and that <br />City Council is not obligated to automatically grant <br />approval for continued use of the holding tank. <br /> <br />(5) That the holding tank be pumped out at least one time <br /> <br /> <br />
