CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 78-201 A RESOLUTION OF THE CITY COUNCIL DENYING THE APPEAL OF THE CITY COUNCIL OF A DECISION OF THE PLANNING COMMISSION APPROVING THE APPLICATION OF TAM INVESTMENT COMPANY FOR A CONDITIONAL USE PERMIT TO ALLOW THE USE OF A SMALL PORTION OF THE 1.8 ACRE PARCEL ZONED "P" (PUBLIC AND INSTITUTIONAL) LOCATED ON THE NORTH SIDE OF VALLEY AVENUE APPROXIMATELY 400' EAST OF HOPYARD ROAD FOR THE PARKING OF AUTOMOBILES IN CONJUNCTION WITH A SHOPPING CENTER PROPOSED TO BE LOCATED IMMEDIATELY WEST OF THE SUBJECT SITE WHEREAS, the Planning Corfanission approved On July 12, 1978, the application of Tam Investment Company for a conditional use permit to use a portion of the "P" site for parking subject to the conditions of Planning Commission Resolu- tion No. 1655 because all of the required findings could be made to grant this use permit; and WHEREAS, this application was appealed by the City Council to enable them to totally review this case; and WHEREAS, a public hearing was held before the City Council on August 8, 1978; and WHEREAS, upon review the City Council found that required findings could be made and approved this application subject to appropriate conditions. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. The City Council denies the appeal of case UP-78-11 subject to the following conditions: That approval is subject to all of the conditions shown on Planning Commission Resolution No. 1655 attached hereto and made part of this case by refer- ence. That the Public and Institutional portion of the site be prohibited from being used for a construc- tion yard during constrution of the "C" area. Section 2. This resolution shall become effective immediately. THIS RESOLUTION ADOPTED ON AUGUST 8, 1978, BY THE FOLLOWING VOTE: AYES: Councilmembers Butler, NOES: Councilmember Brandes ABSENT: None ABSTAIN: None Kephart, Wood and Mayor Mercer III
