CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 78-285 <br /> <br />A RESOLUTION APPROVING AND AMENDING AGREEMENT FOR <br />REIMBURSEMENT OF COSTS BY PROPERTY OWNERS FOR <br />CONSTRUCTION OF SANITARY SEWER IN PETERS AVENUE <br /> <br />WHEREAS, City will be constructing certain improvements in Peters Avenue; and <br /> <br />WHEREAS, certain property owners have agreed to pay for a sanitary sewer as <br /> part of said improvements; and <br /> <br />WHEREAS, said agreement was based on an estimate made by City; and <br /> <br />WHEREAS, based on unit bid prices the cost of installing said sewer will be <br /> considerably in excess of the estimate; and <br /> <br />the City Council has reviewed the matter and determined that it would <br />not be equitable for the City to charge the property owners on the <br />basis of the unit bid prices. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS <br />FOLLOWS: <br /> <br />Section 1. The City Council hereby approves the Agreement for Reimbursement For <br /> Street improvement Costs attached hereto and as amended below and <br /> authorizes the Mayor to sign said agreement. <br /> <br />Section 2. Said Agreement is hereby amended to stipulate that property owners <br /> obligation shall be limited to $5,000. <br /> <br />Section 3. The balance of the cost of said sewer line shall be paid by the City <br /> from the Sewer improvement Fund and the budget is hereby amended <br /> accordingly. <br /> <br />THIS RESOLUTION WAS ADOPTED ON NOVEMBER 14, 1978, BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmen Brandes, Kephart, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilman Butler <br /> <br />ATTEST: <br /> TH R.
