CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 79-31 <br /> <br />A RESOLUTION GRANTING A 5'FT. EASEmeNT ACROSS <br />LOT 106, TRACT 2837, FOR WALL MAINTENANCE OF <br />LOT 105, TRACT 2837. <br /> <br />WHEREAS, <br /> <br />Morrison Homes has requested that the City grant a <br />5 ft. wide maintenance easement across the southwest <br />edge of Heatherlark Park to the current and future <br />owners of Lot 105, Tract 2837, said property commonly <br />known as 2511 Heatherlark Circle, Pleasanton, to <br />enable the owners to have legal access to maintain the <br />existing garden court home wall; and <br /> <br />WHEREAS, <br /> <br />Maintenance of this and the adjacent walls is required <br />as a condition of development approval for Tract 3996, <br />Northway Downs; and <br /> <br />WHEREAS, <br /> <br />The City Council, at their March 13, 1979, meeting <br />received a report from the Director of Public Works <br />and Utilities, indicating that the grant of easement <br />is in the public interest. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL RESOLVES AS FOLLOWS: <br /> <br />Section 1. <br /> <br />That a grant deed be recorded conveying a 5 ft. easement <br />across Lot 106, Tract 2837, to allow the current and <br />future owner of Lot 105, Tract 2837, to maintain the exist- <br />ing garden court home wall. <br /> <br />Section 2.
