CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 79-44 <br /> <br />APPROVAL OF RENEWAL OF HOLDING TANK PERMITS AND AGREEMENT <br />FOR EARL ADAMS TILE AND COPING COMPANY <br /> <br />WHEREAS , <br /> <br />on March 10, 1975, the City Council approved by Resolution <br />No. 75-55, a permit for Mr. Earl Adams for the construction <br />of a holding tank for his proposed development of a contrac- <br />tor's yard and warehouse at 3675 Santa Rita Road; and <br /> <br />WHEREAS, <br /> <br />subsequent to that approval, permits were approved in 1977 <br />for Mr. Adams to use the existing holding tank at 3675 <br />Santa Rita Road for two additional buildings on the same <br />parcel of property; and <br /> <br />WHEREAS, <br /> <br />three separate agreements were executed for each of the <br />holding tank permits and these agreements have now expired; <br />and <br /> <br />WHEREAS, <br /> <br />Mr. Adams has now applied for renewal of the three permits <br />and staff has recommended approval of the same, subject to <br />execution of a new agreement and authorization to issue a <br />permit to continue the use of the holding tank at 3675 <br />Santa Rita Road; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1~ Approves the continued use of a holding tank for Earl <br /> Adams Ti:le and Coping Company at 3675 Santa Rita Road to <br /> provide sewerage service for the three buildings known as <br /> 3657, 3663 and 3675 Santa Rita Road, subject to the follow- <br /> ing conditions: <br /> <br />(a) <br /> <br />That the use of the existing tank at 3675 Santa Rita <br />Road be considered satisfactory only so long as the <br />parcel containing the three structures to be served <br />by this holding tank remains as a single parcel of <br />land. <br /> <br />(b) <br /> <br />That the permit for the holding tank shall be auto- <br />matically terminated in the event that the parcel <br />is divided from the site upon which the holding <br />tank is located. <br /> <br />Section 2. Approves the execution by the Mayor of the standard <br /> holding tank agreement and issuance of the permit which <br /> may be renewed annually upon application by Mr. Adams and <br /> approval by City Council at that time. <br /> <br />Section 3. This resolution shall be effective immediately. <br /> <br /> <br />
