CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-80 <br /> <br />A RESOLUTION DECLARING THAT CITY COUNCIL RESOLUTION <br />NO. 79-47 IS NOT A PROPER SUBJECT OF REFERENDUM AND <br />THEREFORE NO SPECIAL ELECTION SHOULD BE CALLED <br /> <br />WHEREAS, <br /> <br />the City Clerk of the City of Pleasanton received on <br />April 30, 1979, a referendum petition regarding the Council's <br />adoption of Resolution No. 79-47 on March 29, 1979, select- <br />ing as the Railroad Track Consolidation Project the Western <br />Pacific Alignment with specific elements, modifications and <br />mitigation measures, and including the connection of Del <br />Valle Parkway to Main Street; and <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />the Alameda County Registrar of Voters had certified on <br />May 8, 1979, that there was a qualified number of registered <br />voters signing the Referendum Petition; and <br /> <br />the City Attorney advised the Council that the Elections Code <br />requires the Council to repeal the action referended in its <br />entirety or to call a special election to be held not earlier <br />than 74 nor later than 89 days from May 8, 1979, unless the <br />Council determines that the action referended was not a <br />proper subject for such action; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Declares that Resolution No. 79-47 was not a proper <br /> subject of referendum and, therefore, no special election <br /> should be called. <br /> <br />Section 2.
