CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 79-96 A RESOLUTION DENYING THE APPEAL OF ROBERT PEARSON AND JOHN FRAGA FROM A DECISION OF THE DESIGN REVIEW BOARD THAT A CONCRETE PRODUCTS MANUFACTURING PLANT PROPOSED TO BE CONSTRUCTED ON THE WEST SIDE OF VALLEY AVENUE BETWEEN THE ~STERN PACIFIC RAILROAD TRACKS AND UTILITY VAULT PROPERTY WOULD NOT HAlrE A SIGNIFICANT IMPACT ON THE ENVIRONMENT. WHEREAS, ~ESTERN CONCRETE PRODUCTS COMPANY made application for design review approval of a pre-cast concrete products facility to be located on a 7-acre site between the Western Pacific Railroad tracks and the Utility Vault property; and WHEREAS, the Design Review Board, at its meeting of May 9, 1979're- ceived a staff report on the application, an initial study for an environmental impact report prepared for the project and testimony from the applicant and the community; and WHEREAS , at that meeting the Design Review Board made the findings re- quired for a negative declaration and approved the design for the construction of a pre-cast concrete products manu- facturing plant proposed to be constructed on the 7-acre site; and WHEREAS, Robert Pearson and John Fraga appealed the negative declaration on the project and requested a hearing before the City Council on the question of environmental impacts of the pro- ject; and WHEREAS, the City Council, at its June 12, 1979 meeting, received a staff report from the Director of Planning dated June 4, 1979, and at a public hearing took testimony from the applicant, its representative and staff and the public; and WHEREAS, the City Council made the finding that the project would not have a significant impact on the environment other than some increase in traffic; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1. Denies the appeal of Robert Pearson and John Fraga of a decision of the Design Review Board that a concrete products manufacturing plant proposed to be located on the west side of Valley Avenue between the Western Pacific Railroad Tracks and Utility Vault property would not have a significant im- pact on the environment, and requires as a mitigating measure on the Negative Declaration that Western Concrete Products Company use E1 Charro Road or other public road to 1-580 if available.
