CITY OF PIFASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 79-91 A RESOLUTION APPROVING A NEGATIVE DECLARATION FOR REZONING APPLICATION OF W. R. GRACE DEVELOPMENT COr~ANY TO REZONE A 1.75 ACRE SITE AT 5305 HOPYARD ROAD TO PUD (PLANNED UNIT DEVELOPMENT) DISTRICT WHEREAS, the City Council, at its meeting of May 22, 1979, received a proposed negative declaration for the rezoning of an approximately 1.75 acre parcel owned by Wo R. Grace Com- pany located at 5305 Hopyard Road from the C-F (Commercial Freeway) District to PUD (Commercial) District;and WHEREAS, said proposal was based upon an Initial Study done pursuant to the Environmental Impact Guidelines and Procedures adopted by the City Council of the City of Pleasanton by Resolution No. 77-66; and WHEREAS, the City Council, at its meeting of May 22, 1979, received the Initial Study and proposed Negative Declaration in a report from the Director of~Planning dated May 15, 1979, regarding the proposed rezoning; and WHEREAS, the City Council was advised by the City Attorney of their responsibilities in reviewing the proposed Negative Decla- ration and the determinations required by Section 5.4(e) of Resolution No. 77-66; and WHEREAS, each member of the City Council had before them copies of Resolution No. 77-66 at the time of considering the proposed Negative Declaration and Initial Study; and WHEREAS, the public was afforded an opportunity to comment on the proposed environmental assessment, which had previously been published in the Pleasanton Times, at the time of the public hearing on the rezoning proposal; and WHEREAS, upon receipt of the staff report and public input, the City Council reviewed the provisions of the City's Guidelines and Processing Procedures for the evaluation of projects and the preparation of Environmental Impact Reports as they pertain to requirements for Negative Declarations and Environmental Impact Reports in order to determine if a Negative Declaration is appropriate for the project and what mitigation measures, if any, must be undertaken to ensure that the project will not have a significant impact upon the environment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: Section 1. The City Council reviewed the contents of Resolution No. 77-66 (Environmental Impact Guidelines and Procedures) as they pertain to the requirements for Negative Declara- tions and Environmental Impact Reports and determines that the proposed rezoning requested in PUD-79-3, to rezone
