CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-120 <br /> <br />A RESOLUTION OF THE CITY COUNCIL DENYING WITHOUT PRE- <br />JUDICE, THE APPEAL OF CENTEX HOMES FROM A DECISION OF <br />THE PLANNING COMMISSION DENYING CASE PUD-79-1 (PLANNED <br />UNIT DEVELOPMENT) FOR A PROPOSED 116 UNIT SINGLE-FAMILY <br />DETACHED RESIDENTIAL COMPLEX TO BE LOCATED ON A 32.4 <br />ACRE SITE. <br /> <br />WHEREAS, <br /> <br />CENTEX HOMES has made application for a Planned Unit <br />Development approval for a 116 unit, single-family de- <br />tached residential complex to be located on a 32.4 acre <br />site located between the Pleasanton School upper play- <br />field and Mirador Drive and immediately southerly of the <br />residences bordering Angela Street; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission, at its meeting of June 13, 1979, <br />received a staff report on the application, an Initial <br />Environmental Study prepared for the project and testimony <br />from the applicant and the community; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission entered and adopted Resolution <br />1749, attached hereto and incorporated by reference herein, <br />denying the development plan; and <br /> <br />WHEREAS, the applicant requested a hearing before the City Council <br /> on his denied application; and <br /> <br />WHEREAS, a public hearing on the request was set for July 24, 1979; <br /> and <br /> <br />~HEREAS, <br /> <br />the City Council, at its July 24, 1979, meeting received <br />a staff report, Initial Environmental Study and at a public <br />hearing took testimony from the applicant, his representative, <br />staff and the public; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br />Section 1. Denies without prejudice the appeal of Centex Homes from a <br /> decision of the Planning Commission denying a Planned Unit <br /> Development plan for a proposed 116 unit single-family detached <br /> residential complex, and incorporates by reference Resolution <br /> 1749 attached hereto as Exhibit A, of the Planning Commission <br /> denying the application filed by Centex Homes. <br /> <br />Section 2. This resolution shall be effective immediately upon its <br /> passage and adoption. <br /> <br />III <br /> <br /> <br />
