CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 79-112 <br /> <br />AUTHORIZING THE CITY STAFF TO PROVIDE FOR A CONTRACT FOR <br />A BICYCLE PATH ON SANTA RITA ROAD WITHOUT USING THE BIDDING <br />PROCESS DUE TO THE IMMEDIATE DANGER TO SAFETY OF SCHOOL <br />CHILDREN <br /> <br />WHEREAS, <br /> <br />residents in the Pleasanton Meadowsarea have urged the City <br />to construct a pedestrian-bicycle pathway on Santa Rita Road <br />for the use of children attending local schools because the <br />school district is planning to eliminate bussing; and <br /> <br />WHEREAS, <br /> <br />at its meeting of July 10, 1979, the City Council received <br />and considered the report of the Director of Public Works <br />and Utilities dated July 3, 1979 regarding this matter and <br />members of the public were given an opportunity to comment <br />on the proposal; and <br /> <br />WHEREAS, <br /> <br />pursuant to Government Code §37906, Council may pass a res- <br />olution by a 4/5ths vote of its members declaring that the <br />public interest and necessity demand the immediate expenditure <br />of public money to safeguard life, health, or property; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Authorizes the City Staff to provide for a contract for <br /> the Pedestrian-Bicycle Pathway on Santa Rita Road without <br /> using the bidding process due to the immediate danger to the <br /> safety of children in the City of Pleasanton because of the <br /> imminent elimination of the school bussing program which will <br /> cause increased use of bicycles in the area. <br /> <br />Section 2. The total cost of the project is to be $20,000 to $25,000 <br /> with the total amount being determined by the Engineering <br /> Department. <br /> <br />Section 3.
